ALERT: California Intends To Proceed with New Privacy Act Enforcement Despite Pandemic

On Friday, March 27, the IAPP (International Association of Privacy Professionals) published a notice that California's Attorney General does not view the current COVID-19 events as a reason to delay enforcement of the California Consumer Privacy Act.  The CCPA entered into force on January 1 of this year, but AG's regulations on implementation and enforcement of the Act are due by July 1. 

COVID-19 has raised concerns by a number of companies as to their ability to have operations compliant by July 1.  However, an advisor to the AG's office stated the agency is "committed to enforcing the Act upon finalizing the rules or July 1, whichever comes first".  Further, the AG's office "encourages businesses to be particularly mindful of data security in this time of emergency."

In view of this announcement, businesses covered by the Act should proceed to adopt a CCPA-compliant privacy policy and institute internal measures to comply with the Act.
